Recent questions from the field have prompted us to clarify Athene Annuity's position on cross border sales. A cross border sale occurs when a resident of one state purchases an annuity contract in another state. Athene Annuity & Life Assurance Company operates in strict compliance with state regulations governing cross-border sales. Five states prohibit out-of-state sales to residents, regardless of the circumstances or the connection to the non-resident state:
Alabama Massachusetts Minnesota Utah Wisconsin Any non-resident application submitted for a resident of one of these states will be declined. In addition, as Athene Annuity & Life Assurance Company is not authorized to do business in New York we cannot accept any application from a New York resident agent where the applicant also resides in New York, regardless of where the application is signed. As a company, we do not encourage cross border sales. In states that do not expressly prohibit these transactions producers must adhere to the following sales practices: - The producer must be licensed and appointed in the state where the solicitation takes place.
- The policy must be solicited, sold and delivered in the same state.
- Effective immediately the Out of State Verification (form N1271), which is available on our website, must be completed and accompany every application involving a cross-border sale.
